Unattended Health Problems

Nursing Home Abuse Wheel Chair Alone Lawyer Attorney

Unattended health and medical needs of residents in Arizona nursing homes can include neglect to diagnose medical conditions, failure to provide proper medication and treatment for medical problems and injuries, as well as not providing necessary health aids, such as eyeglasses or dentures. If your or a loved one has experienced medical conditions in an Arizona nursing home or long-term facility that have not sufficiently been attended to, you may have grounds for a personal injury case. To find out if you do, contact James Morgan at our premier Nursing Home Abuse Law Firm  for a free nursing home abuse evaluation.

Often, many medical conditions that are not detected and treated can result in serious health consequences for elderly nursing home patients that lead to emergency hospital visits, wrongful death and medical negligence lawsuits. Some examples include:

  • Unattended fractures or broken bones from falls
  • Untreated wounds or cuts that result in infection or sepsis
  • Unattended skin conditions, such as rashes, friction burns or bed sores
  • Untreated pain and failure to determine its source
  • Untreated dental problems that can lead to dysfunctional consumption of food
  • Unattended respiratory conditions
  • Unattended catheters that can lead to infections
  • Untreated foot conditions, such as ingrown toe nails, corns or blisters
  • Untreated constipation that can lead to an impacted bowel

In recent years, there have been horrifying accounts of complications arising from impacted bowels in several nursing homes. Fecal impaction is a severe type of constipation that can be quite painful and is not uncommon in nursing homes.

In 2006, a New Hampshire nursing home resident was hospitalized after the staff neglected to prevent and recognize that she had a serious bowl condition. The facility was found to have failed to provide “bowel management care services” to 47 of the 87 residents screened.

In a Florida nursing home, a nurse’s aide told a resident's family member and the nursing home staff that he suspected the resident had an impacted bowel. Not only did the staff misrepresent the patient's bowel movements and diet, they failed to make entries on his chart and falsified records. When he died, an autopsy report revealed a severely impacted bowl and colon.

In yet another case, a Kentucky nursing home resident died from a heart attack after his repeated calls for help with abdominal pain went unanswered. The autopsy revealed a severely impacted bowl.

Most certainly, any complaints of pain that a nursing home resident may have should be immediately addressed by the staff and continual pain should be investigated to determine the cause of the pain. Appropriate treatment of the cause should be given, including pain medications. Failure to do so is may be grounds for medical malpractice.

In the same respect, any health provider knows that an open wound is susceptible to infection. When nursing home staff fails to treat and monitor open wounds, infection can quickly develop and lead to sepsis. Sepsis is a life-threatening disease frequently seen in elderly persons because of their vulnerable immune systems.

My father was the victim of horrible neglect by a nursing home, which caused his death. I have never been involved in anything having to do with the legal system, and even after my father’s death, I was very reluctant to look for an attorney to advise me about a potential case.  Luckily, I was referred to attorney James Morgan. Mr. Morgan was honest and supportive through the whole process.  Within four months, my case was settled.  I am hopeful that through my father’s case, as well as the efforts of Mr. Morgan and his law firm, nursing homes will create safer and better living conditions for their residents so that other residents and their families will not have to suffer as my father and my family did. My family and I will always be grateful for Mr. Morgan’s kindness and competence, and the peace of mind we now have thanks to the resolution of our case.
